The House of Commons Library recently published (29 August 2018) a briefing paper on the Right to Rent checks which private landlords in England must carry out when renting a property. These checks were introduced through the Immigration Act 2014. Additional provisions were introduced through the Immigration Act 2016. The briefing paper outlines all of the landlord’s responsibilities, the Government’s reasoning behind the legislation, areas of controversy around the policy, the challenge to the policy in the High Court (due to be heard on 18 and 19 December 2018). The legislation allows for the policy to be extended to Scotland, Wales and Northern Ireland but the devolved nations are not supportive of this.
